2025 Divorce Legislation

During the 2025 Session Virginia General Assembly session, three bills affecting divorces were passed, but vetoed by Governor Youngkin.
 
The first was a bill to streamline property division in no-fault divorces (HB 1234). This veto preserved existing requirements for equitable distribution, leaving some couples with lengthier, costlier processes. 
 
The second bill would have allowed parties to file for a divorce from "bed and board" on a no-fault basis. Virginia Law currently requires allegations of fault to file for a divorce from bed and board.
 
The third bill would have removed from grounds for divorce adultery committed by a party after the parties separated. In Virginia, adultery committed after separation but prior to a divorce is still grounds for divorce under a Virginia Supreme Court opinion.
 
These outcomes highlight Virginia's cautious approach to divorce law reform in 2025.
